Four Four Consultancy Limited shall not in any circumstances be liable to the client for any losses purported to have been suffered for whatever reason.

Four Four Consultancy Limited reserves the right to:

1. add or to remove any material from the website or to amend, alter, redesign or change anything contained in it at any time
2. monitor, suspend, revoke or otherwise limit access to the website at any time

The use of this website is at the user’s own personal risk. Four Four Consultancy Limited does not warrant the content or accuracy of any material nor does it warrant that the website is free from errors, faults, viruses or other computer or data corrupting material. Whilst every endeavour will be made to ensure that the website is free of errors, Four Four Consultancy Limited cannot accept responsibility for any losses incurred due to malfunction of the website or any part of it.

Website Design Services

Any person or company undertaking the services of Four Four Consultancy Limited agrees to the terms and conditions as set out.

Four Four Consultancy Limited shall not in any circumstances be liable to the client for any losses purported to have been suffered for whatever reason.

Four Four Consultancy Limited reserves the right to refuse to handle any material which may be deemed offensive, illegal or controversial and will terminate the hosting service should the need arise.

Four Four Consultancy Limited designs bespoke websites, logos etc. in good faith but does not complete formal trademark checks. We accept no liability for any financial or other losses incurred in relation to trademark infringement.

Four Four Consultancy Limited reserves the right to reproduce any of its artwork, including approved websites for promotional purposes. The terms and conditions contained herein can be amended at any point as necessary.

Quotations

Any work requested will be quoted for and the quotation is valid for 30 days from the date of issue.

Any additional work requested that is beyond the scope of the original quote, will be charged at a rate of £50 per hour.

Four Four Consultancy Limited reserves the right to revise and amend an initial quote to a client if necessary.

Web Design & Build

Upon agreement of the quote and receipt of deposit payment, the build process will begin and an illustration will be created. The illustration will correlate to the quotation and any subsequent additional articles/pages will be deemed to be outside of the original quotation remit and will be quoted for accordingly. Once this has been approved, the website will be built and any changes will be deemed to be an alteration and incur additional charges.

Four Four Consultancy Limited cannot take responsibility for any copyright infringements caused by materials submitted or suggested by the client.

Four Four Consultancy Limited uses clients’ own material e.g. text, information, images to design websites and is not responsible for these materials.

For larger projects, Four Four Consultancy Limited shall set out milestones for the agreed work and attach invoicing points to relevant milestones. The Client should check and agree to these before the work commences. We will ask for agreement that a milestone has been completed (usually by email). This acts as acceptance and sign-off on the work completed to that point. Any desired amendments to work carried out up until an agreed and completed milestone could result in additional costs to the Client. Four Four Consultancy Limited will always raise and discuss such occurrences and any cost associated will be agreed with the Client before work continues. Four Four Consultancy Limited reserves the right to issue an interim payment at any point should a project be deemed to be taking longer for whatever reason. This will be issued to recover any costs incurred.

Prior to completion of work, Four Four Consultancy Limited will test it properly and ensure it meets the agreed specification. This will include testing functionality, cross-browser and cross-device compatibility. Four Four Consultancy Limited will give best advice with regards readiness of site launch. Upon completion and acceptance, the website will be considered defect free and complete. If the client does not agree, notification in writing will need to be received within 14 days from the date on which the website has been launched. If a site is incomplete for longer than 3 months and approval/content is not received within that time, Four Four Consultancy Limited reserves the right to remove all hosted files and cancel the contract, the initial deposit being non-refundable as it is used to cover all costs incurred up until that point.

Website Errors

Four Four Consultancy Limited will support the completed work for a period of 1 month should the Client NOT take out a maintenance agreement. This means that Four Four Consultancy Limited will fix any errors reported during this 1 month period. Clients taking out a formal maintenance will be covered for the 12 monthly contract period.

Payment

A non-refundable deposit is required before any work is carried out. A further payment may be required before completion dependent upon the duration of the project – the payment schedule will be detailed on the initial quotation. In all cases, hosting fees and any other costs incurred by Four Four Consultancy Limited are required in advance and are non-refundable. Once the brief of the quotation has been met, an invoice for all outstanding monies will be raised. Any alterations at this stage will be completed at the discretion of Four Four Consultancy Limited. Payment of a deposit confirms agreement to Four Four Consultancy Limited terms and conditions.

Subsequent payment terms, unless stated, are 7 days from date of invoice. Failure to adhere to this will result in late payment and administration charges being applied of £25 initially and then £25 for each and every subsequent 7 day period. The client will also be responsible for any legal costs, agency costs and other expenses which may be incurred in the recovery of overdue amounts.

If accounts are not settled within the agreed timescales, access to the related website may be denied until settlement of the account is made.

All additional work will be quoted for and in some instances, at Four Four Consultancy Limited discretion, payment will be required in advance of said work being undertaken. If agreed that payment is after the said work has been completed, Four Four Consultancy Limited’ normal payment terms apply. Failure to adhere to these will result in late payment and administration charges being applied of £25 initially and £25 for each and every subsequent 7 day period. The client will also be responsible for any legal costs, agency costs and other expenses which may be incurred in the recovery of overdue amounts. Four Four Consultancy Limited also reserves the right to suspend the hosting service until outstanding payments are cleared.

Budget Payment Option

Websites designed and built using Four Four Consultancy Limited’s budget payment option have no time constraints with regards to completion dates. Any deposit paid under Four Four Consultancy Limited’s budget payment option is non-refundable.

Client’s using the budget payment option may cancel their arrangement in writing at any time and website services will be suspended.  Cancellation within the first 2 years may also incur additional fees to recover design and build costs. Withholding payment does not cancel the arrangement and any monthly fees will still be accrued and may be recovered until such written advice is received.

Four Four Consultancy Limited reserves the right to take action to recover the total amount outstanding in the event of missed monthly payments and/or failure to adhere to the agreed payment schedule.

Search Engine Optimisation

Where Four Four Consultancy Limited has been asked to provide search optimisation for a client, no guarantee is made of any specific placement or high ranking on search engines.

Hosting

Four Four Consultancy Limited will arrange website hosting with our preferred supplier but no guarantees can be made as to the availability or interruption of this service. Four Four Consultancy Limited cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service. Four Four Consultancy Limited cannot accept liability for any damage and/or disruption caused by any form of hacking, malware, spam or any other malicious attack on any website. Each client owns and therefore has ultimate responsibility for the safety and security of their own website.

If a client has a chosen hosting supplier, Four Four Consultancy Limited can assist in the transfer and uploading of all website files but this will incur additional cost.

Four Four Consultancy Limited shall not in any circumstances be liable to the client for any losses purported to have been suffered for whatever reason.

Fees relating to web hosting or domain names must be paid prior to the expiration date and Four Four Consultancy Limited will contact the client at least one month prior to expiry. If the fees remain unpaid at the due date, the service will be cancelled with immediate effect and an additional charge be raised should reinstatement be requested.

Renewals

The client will be contacted in advance of the domain name registration and hosting fees being due. Failure to renew in a timely fashion, may result in termination of service and the domain name may become available to other buyers. Hosting and domain name registration is provided via a minimum 12 month contract.

Cancellation

Four Four Consultancy Limited services are renewable annually with 1 month’s notice.

Providing all outstanding monies are up to date, a client may cancel at any given time providing Four Four Consultancy Limited with written confirmation 28 days in advance.

Four Four Consultancy Limited may at its discretion suspend or terminate the supply of any goods and services if the client fails to make any payment when it is due or otherwise defaults in any of its obligations.

Our terms stated herein are subject to change without notice. This agreement does not affect your statutory rights.

Maintenance

Site maintenance is available and will be a fixed price monthly or annually.

Website Protection

Four Four Consultancy Limited will routinely check website’s of customers who have purchased website protection or other form of website maintenance to make sure that it is using the latest software version and that all components/plug-ins used are of the latest release. A secure copy of the site will also be stored in an alternative location. We will also monitor attempts to hack into the website and block suspicious IP addresses.

Invalidation of Maintenance Agreement

Should a client have or gain access to their website code files and make changes themselves or edit settings in their content management system which then require rectifying, the maintenance contract will become invalid. Any subsequent work to rectify any issues caused and to bring the website back to state it was before would be chargeable.
